Acceptance of Terms

By accessing or using Play and Learn with David (the "Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. These Terms apply to all visitors, registered parents, and children who access the Platform through a parent account.

Eligibility

The Platform is designed for children aged 3–12, accessed through a parent or legal guardian's account. By creating an account, you confirm that you are at least 18 years old and are the parent or legal guardian of any child profiles you create. Children must not register independently. Accounts created in violation of this rule may be suspended without notice.

Account Security

You are responsible for keeping your login credentials confidential. You agree not to share your password with anyone and to notify us immediately if you suspect unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your account.

Points

Points are the in-platform currency used to unlock and redeem printable worksheets and other premium content. Points can be earned by completing lessons and games, or purchased via Stripe or PayPal. Points are:

  • Non-transferable between accounts.
  • Not redeemable for cash or any monetary equivalent.
  • Subject to our Refund Policy for purchased points.

Printouts

Points may be spent to generate and download printable worksheets. Once a printout is generated and the points have been deducted, the points cannot be refunded. Please review the printout before spending points.

Acceptable Use

You agree to use the Platform only for its intended educational purpose. For detailed rules, see our Acceptable Use Policy. Key prohibited behaviours include:

  • Harassment, bullying, or intimidation of any user.
  • Posting or sending illegal, harmful, or offensive content.
  • Attempting to circumvent parental controls or platform safety features.
  • Using automated scripts or bots to interact with the Platform.

Chat

Users must not share personal identifying information (full name, address, phone number, school) in chat. Users must not bully, harass, or use offensive language toward other users. Violations may result in suspension or permanent removal from the Platform.

Content Ownership

All Platform content — lessons, games, stories, worksheets, artwork, and software — is owned by or licensed to Play and Learn with David. You may not copy, redistribute, or commercially exploit any Platform content without prior written permission.

Avatar images uploaded by parents remain their property. By uploading an avatar, you grant Play and Learn with David a limited licence to display it within the Platform.

Termination

We reserve the right to suspend or permanently terminate any account that violates these Terms, with or without prior notice. Upon termination, access to the Platform and all associated content ceases. Points balances are forfeited on termination due to Terms violations.

Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses. We make no warranty regarding the accuracy or completeness of educational content.

Limitation of Liability

To the maximum extent permitted by applicable law, Play and Learn with David and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.

Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes will be resolved in the competent courts of the jurisdiction where the platform operator is registered.

Changes to These Terms

We may update these Terms from time to time. We will notify registered parents by email of material changes. Continued use of the Platform after changes are effective constitutes acceptance of the revised Terms.
